Murphy v. Fidelity & Casualty Co.

Opinion of the Court

In re: United States Casualty Company applying for certiorari, or writ of review, to the Court of Appeal, Second Circuit, Parish of Bienville. 165 So.2d 497.

Writ refused. On the facts found by the Court of Appeal we find no error of law in its judgment.

McCALEB, J., is of the opinion that a writ should be granted. SUMMERS, J., is of the opinion that the facts do not warrant the application of Article 2322 of the LSA-Civil Code and a writ should be granted.
