In re: Mrs. Myrtle Dyson Miles applying for certiorari, or writ of review, to the Court of Appeal, First Circuit, Parish of East Baton Rouge. 253 So.2d 681.

Writ refused. On the facts found by the Court of Appeal, we find no error of law in its judgment.

TATE, J., respectfully dissents,

being of the opinion that the reasoning and result is inconsistent with the principles announced by this Court in Saxton v. Plum Orchards, 215 La. 378, 40 So.2d 791.
