State ex rel. Berry v. Henderson

Opinion of the Court

In re: Joseph Lee Berry applying for remedial writ and writ of habeas corpus.

Writs refused. The showing made does not warrant the exercise of our original or supervisory jurisdiction.

Dissenting Opinion

BARHAM, J.,

would not consider the application to allow completion of record or require supplemental filing of minute entry as to counsel. In absence of an affirmative showing of waiver of counsel or presence of counsel there must be an evi-dentiary hearing.
