State v. Henderson

Supreme Court of Louisiana
State v. Henderson, 275 So. 2d 866 (La. 1973)
1973 La. LEXIS 5574
Barham, Henderson, Rel, State, Tate

State v. Henderson

Opinion of the Court

In re: Robert Robinson applying for writs of certiorari and habeas corpus.

Writ denied. The record shows that applicant is not entitled to relief prayed for.

Concurring Opinion

BARHAM, J.,

is of the opinion an evi-dentiary hearing is required under Boykin v. Alabama, 395 U.S. 238, 89 S.Ct. 1709, 23 L.Ed.2d 274. The minutes and colloquy show that no explanation was given of the constitutional rights which are waived by a guilty plea. This is a post Boykin plea.

TATE, J., concurs in denial. See State ex rel. LeBlanc v. Henderson, 261 La. 315, 259 So.2d 557 (1972).
