State ex rel. Livas v. Henderson
Supreme Court of Louisiana · Decided June 28, 1973 · Tate
279 So. 2d 684; 1973 La. LEXIS 6150 (Southern Reporter, Second Series)

State ex rel. Livas v. Henderson

Opinion of the Court

In re: Darrel Lynn Livas applying for remedial writs and writ of habeas corpus.

Writ denied. The showing made does not warrant the exercise of our jurisdiction.

Concurring Opinion

TATE, J.,

concurs in the denial of an evi-dentiary hearing on his understanding that the contentions now raised in this court were not raised in the application to the trial court which is sought to be reviewed, namely, the allegations as to illness being used to induce a plea and as to ineffective counsel. Further, the contemporaneous transcript of the plea of guilty adequately indicates compliance with Boykin.
