Molinario v. Cronvich

Dissenting Opinion

BARHAM, J.,

is of the opinion the writ should be granted. The plea of guilty is defective under Boykin v. Alabama, 395 U.S. 238, 89 S.Ct. 1709, 23 L.Ed.2d 274 (1969).

Opinion of the Court

In re: Ivan Leon Molinario applying for writ of habeas corpus and review of denial of writ of habeas corpus by the district court.

Writ denied. The evidence at the evi-dentiary hearing shows the plea of guilty was voluntarily and intelligently made as a result of a plea bargain.
