ORDER

The Court being of the opinion that Gideon v. Wainwright is retroactive:

Ordered that an evidentiary hearing be held on relator’s petition for habeas corpus *600to determine whether he was represented by counsel at the time of his arraignment and sentence or whether he waived counsel and that the trial judge render an appropriate judgment thereon.
