State v. Robertson

State v. Robertson
Supreme Court of Louisiana · Decided November 21, 1973 · Barham
284 So. 2d 780; 1973 La. LEXIS 6393 (Southern Reporter, Second Series)

State v. Robertson

Opinion of the Court

In re: Alton E. Robertson applying for writs of certiorari and habeas corpus.

Application denied. The ruling of the trial court is correct. In addition, the applicant does not show that any bill taken, but not perfected, had merit.

Dissenting Opinion

BARHAM, J.,

is of the opinion a new and out of time appeal should be granted. Our appellate review is limited to bills of exceptions perfected and errors discoverable on the record. Bills were reserved below including one to a motion to suppress — counsel failed to perfect bills — relator has not had an effective appeal.
