Writ denied. On the facts found by the Court of Appeal the result is correct.

Dissenting Opinion

CALOGERO, J.,

dissents from refusal to grant. Both the trial and appellate courts seem to have required of plaintiff a burden of proof not required of a fare paying common carrier passenger. See Wise v. Prescott, 244 La. 157, 151 So.2d 356 (1963).
