Writ denied. On the facts found by the Court of Appeal the result is correct.

Dissenting Opinion

TATE, DIXON and CALOGERO, JJ.,

are of the opinion that the writ should be granted. Tate, J., is of the additional opinion that this court should consider the issue raised of tort liability of the insurer for its failure to furnish medical treatment in violation of its independent obligation (by stipulation pour autrui) to the injured workman whether or not penalties are assessable.
