State v. Pearce

State v. Pearce
Supreme Court of Louisiana · Decided May 24, 1974 · Calogero, Dixon, Marcus
294 So. 2d 824; 1974 La. LEXIS 4595 (Southern Reporter, Second Series)

State v. Pearce

Opinion of the Court

In re: Dave L. Pearce applying for Writ of Certiorari.

Writ denied. This Court will not consider interlocutory orders and interfere with the orderly proceedings in the trial court in the absence of palpable error or irreparable injury, and then only to prevent great harm to the applicant. Applicant has an adequate remedy for review in the event of conviction.

Concurring Opinion

DIXON, CALOGERO and MARCUS, JJ.,

concur in the denial because the application shows that the applicant executed a waiver before appearing and testifying before the grand jury.
