State ex rel. Department of Highways v. Ourso

Opinion of the Court

In re: E. J. Ourso, Andrew J. Falcon, Adeline D. Blum and Barbara Blum Armstrong applying for certiorari, or writ of review, to the Court of Appeal, First Circuit, Parish of Ascension, 294 So.2d 235.

Writ denied. Under the facts we find no error of law in the Court of Appeal opinion.

SUMMERS, J., dissents from the refusal to grant writs. It is implicit from the undisputed facts that severance damage did in fact result to the property of defendants.
