State v. Fagen

Concurring Opinion

SUMMERS, J.,

concurring. In my view this Court should order applicant to divulge to the trial Court the basis for his motion for continuance. Since this action has not been taken, however, I am of the opinion the order to that effect should issue from the trial Judge.

Opinion of the Court

In re: Bernard A. Horton applying for writs of mandamus, prohibition and certio-rari.

Writ refused. The relator may divulge the factual basis for the alleged conflict of interest if ordered to do so by the trial judge. See Disciplinary Rule 4 — 101(C) (2), Vol. 21A, Louisiana Revised Statutes.
