Opinion of the Court

In re: Lawrence Junda, Jr. applying for Habeas Corpus, Certiorari, Prohibition and Mandamus.

The motion to vacate [order of October 24, 1974, 302 So.2d 21] filed by the state is denied; the showing made is insufficient to warrant further proceedings in this court. The bill of information under which defendant was sentenced does not charge a second offense. The district court is ordered to resentence the applicant.
