State ex rel. Dixon v. Henderson

State ex rel. Dixon v. Henderson
Supreme Court of Louisiana · Decided November 15, 1974 · Barham
302 So. 2d 616; 1974 La. LEXIS 4172 (Southern Reporter, Second Series)

State ex rel. Dixon v. Henderson

Dissenting Opinion

BARHAM, J.,

is of the opinion the writ should be granted. A multiple offender bill may be contested — therefore it requires a plea. A plea of guilty in such a case is governed by the law applicable to all pleas of guilty. There is no showing of knowing and voluntary plea waiving constitutional rights.

Opinion of the Court

In re: Albert Dixon applying for writs of habeas corpus, certiorari, prohibition and mandamus.
