State ex rel. Cage v. Henderson

Opinion of the Court

In re: Percy Cage applying for Writ of Habeas Corpus.

Writ denied. The showing made does not warrant the exercise of our supervisory jurisdiction.

Dissenting Opinion

BARHAM, J.,

is of the opinion an evi-dentiary hearing is required. Our statutory law does not permit a writ denial to be based upon affidavits. A hearing must be held if the application makes allegations that warrant habeas relief.
