BARHAM, J.,

concurs in the writ denial. The Court of Appeal cited the proper authority of law — Civil Code Article 2321 — Under Holland v. Buckley, 305 So. 2d 113, Docket No. 54,317 this court has redefined the responsibility under that article of the Code and that holding applies here and supports the result reached by the Court of Appeal.
