Opinion of the Court

In re: W. J. Gayle & Sons, Inc. applying for certiorari, or writ of review, to the Court of Appeal, Third Circuit, Parish of Vermilion. 300 So.2d 599.

Writ denied. The result is correct.

Concurring Opinion

BARHAM, J.,

concurs. There was no acknowledgment contemplated by C.C. art. 3520. However, the Court of Appeal could have found as a matter of fact a physical interruption of possession by Acadia Vermilion Rice Irrigation Co., thus, the result would be correct.

CALOGERO, J., dissents from the refusal to grant.
