Application denied. The showing made does not warrant the exercise of our jurisdiction.

Dissenting Opinion

BARHAM, J.,

dissents. The relator has simply asked for a hearing to determine the date of filing of the bill of information. The date on the copy furnished relator and us does not conform with the form of the remainder of the instrument. Moreover, regardless of date, relator should have been granted a preliminary examination. Pugh v. Rainwater, 5 Cir., 483 F.2d 778.
