Opinion of the Court

In re: Merle Scott Edmonson applying for certiorari, or writ of review, to the Court of Appeal, First Circuit, Parish of Terrebonne. 303 So.2d 897.

Writ denied. On the facts found by the Court of Appeal, the result is correct.

Concurring Opinion

BARHAM, J.,

concurs. The appellate court found both ascendant and collateral relative fit and no reason to disqualify ascendant. However, the language of the opinion in my opinion is 'erroneous. In all cases — ascendants are not mandatorily entitled to tutorship. In proper fact case this law should be examined and clarified in this court. Any error here is factual by the Court of Appeal.
