Opinion of the Court

In re: Robert T. Rumbaugh applying for writs of certiorari, prohibition, mandamus and review and for a stay order.

Writ granted. The motion to quash the indictment is granted; the conviction and sentence are reversed; the defendant is ordered discharged. State v. Wright, (Macon Ridge Roping Club, Inc.), 305 So.2d 406 (La. 1974); State v. Sissons, La., 292 So.2d 523 (1971).

SANDERS, C. J., having dissented in the two decisions relied on, also dissents from the granting of this writ.
