In re: Marion Overton White applying for Certiorari, or writ of review, to the Court of Appeal, Third Circuit, Parish of St. Landry. 306 So.2d 465.

Writ granted: Summary judgment reversed. There is a material issue of fact. Kay v. Carter, 243 La. 1095, 150 So.2d 27 (1963). Case remanded to District Court for further proceedings in accordance with law.

dissents from this ex parte adjudication of this case in chambers. Serious questions of due process are involved in this action. It is moreover in consonant with concepts of fair and open administration of justice.
