Writ denied. There is no abuse of discretion in the ruling of the trial judge.

Dissenting Opinion

DIXON and CALOGERO, JJ.

are of the opinion that the ruling of the trial judge granting the continuance to the State was an abuse of discretion. The State cannot summons the defendant to testify; defendant’s counsel can waive defendant’s right to be present.
