Writ refused. On the facts found by the court of appeal, there is no error of law in its judgment.

TATE, J.,

dissents, being of the view that Thompson v. Warmack, 229 So.2d 352 (La.App. 3rd Cir. 1969) represented a preferable interpretation than that expressed by Louisiana Power and Light Co. v. Lasseigne, 255 La. 579, 232 So.2d 278 (1970).
