Blanchard v. Wicks

Opinion of the Court

In re: Mrs. Nancy Blanchard, wife of/and Larry Blanchard applying for cer-tiorari or writ of review to the Court of Appeal, Fourth Circuit, Parish of Orleans. 314 So.2d 366.

Writ denied. On facts found by the Court of Appeal, the result is correct.

TATE and DIXON, JJ., dissent from the denial.

Dissenting Opinion

CALOGERO, J.,

dissents. No one can deny (and the Court of Appeal has not) that this truck driver was negligent, and his negligence causative of the accident, and that Mrs. Blanchard was free from fault. The law. would therefore require that the passenger, Mrs. Blanchard, recover.
