Supreme Court of Louisiana, 1975

State v. Marrero

State v. Marrero
Supreme Court of Louisiana · Decided October 13, 1975 · Sanders, Summers
320 So. 2d 205; 1975 La. LEXIS 4665 (Southern Reporter, Second Series)

State v. Marrero

Opinion of the Court

In re: State of Louisiana, applying for writs of Certiorari, Mandamus and Prohibition.

Writ denied. The ruling of the trial judge is correct.

Concurring Opinion

SANDERS, G. J.,

concurs in the denial being of the opinion that the ultimate question is whether the trial judge erred in weighing the evidence of probable cause. In his opinion, the showing made is insufficient to warrant the exercise of this Court’s supervisory jurisdiction.

Dissenting Opinion

SUMMERS, J.,

dissents, believing that the trial judge has no authority to order the State to disclose the identity of confidential informers. In this respect the ruling is in error.
