Beninate v. Bodenger

320 So. 2d 560; 1975 La. LEXIS 4795 (Southern Reporter, Second Series)

Beninate v. Bodenger

Opinion of the Court

In re: Vincent A. Beninate, applying for certiorari, or writ of review to the Court of Appeal, Fourth Circuit, Parish of Jefferson. 315 So.2d 372.

Writ refused. On the facts found by the Court of Appeal, the result is correct.

Dissenting Opinion

DIXON, J.,

dissents from the denial; the Court of Appeal opinion and the application leaves serious doubt about the accuracy of the conclusion that plaintiff never had the right to possess by virtue of actual physical adverse possession for more than one year.

CALOGERO, J., dissents.
