In re: Ronald Paul Lapeyrouse applying for Writs of Prohibition, Mandamus and Stay Order.

Granted. The judgment of the trial court denying the motion to withdraw the guilty plea is reversed, and the motion to withdraw the guilty plea is granted and the case is remanded to the district court for further proceedings.

Dissenting Opinion

SUMMERS, J.

Although I am of the opinion the writ should be granted, I would give the trial judge an opportunity to respond before reversing the ruling.
