DIXON, J.,

dissents from the denial; the trial judge could only find that this stop was made because the officers “became suspicious that perhaps he was driving under the influence of alcohol.” There was no probable cause for the stop and search.

Opinion of the Court

In re: Kevin C. Peterson, applying for writ of review.

Writ denied. On the basis of the evidence presented, as appears from the transcript, there was a sound factual basis for the stop, investigation and seizure of the narcotics.
