State v. Gray

Opinion of the Court

In re: Jefferson Gray, Jr. applying for writ of certiorari and review.

Writ denied. The objection to the ad-missability of the test was not urged until the results of the test were admitted. See La. C.Cr.P. art. 841.

Dissenting Opinion

DIXON, J.,

is of the opinion the writ should be granted; it cannot fairly be said that defendant waived the failure to produce the certificate by not objecting timely.

CALOGERO, J., is of the opinion this writ should be granted.
