TATE, J.,

fully concurs. No statements of the defendant were introduced at the trial on the merits. The alleged Miranda violation was not prejudicial. Docket No. 54,926. Insofar as the other contentions, the evidentiary hearing of November 8, 1973, found within our docket No. 54,926, discloses no factual merit to them.
