Clay v. Clay

325 So. 2d 576; 1976 La. LEXIS 3985 (Southern Reporter, Second Series)

Clay v. Clay

Opinion of the Court

In re Mrs. Lynden Howell Clay applying for certiorari, or writ of review, to the Court of Appeal, Fourth Circuit, Parish of Orleans, 322 So.2d 238.

Writ denied. On the facts found, the ■ result is correct.

DIXON, J., is of the opinion the writ should be granted.

Dissenting Opinion

CALOGERO, J.,

would grant this writ. Like the dissenting judge in the Court of Appeal, I do not agree that a showing of Mrs. Clay’s “inaction” after her then attorney was made aware of the execution of the documents is sufficient proof of ratification.
