TATE, J.,

concurs. Technically, this matter seeking civil relief should have been presented to the Court of Appeal. In absence of a motion in the trial court to appoint an attorney to represent the absent wife, see La.Code of Civil Procedure, Art. 5091, this petition presents no recognized claim for relief.
