Hemsley v. Sims

Supreme Court of Louisiana
Hemsley v. Sims, 328 So. 2d 374 (La. 1976)
1976 La. LEXIS 4739
Calogero, Dixon, Grant, Writ

Hemsley v. Sims

Opinion of the Court

In re: Doris Hemsley applying for cer-tiorari, or writ of review, to the Court of Appeal, Second Circuit, Parish of Caddo. 325 So.2d 877.

Writ refused. Under the factual determination of the jury approved by the court of appeal, we cannot say the result is erroneous as a matter of law.

Dissenting Opinion

DIXON, J.,

is of the opinion the writ should be granted. The majority opinion *375makes no factual finding. From what we have before us, the jury was so wrong that even those who rest on the “Manifest error” doctrine should conclude that the verdict was erroneous.

CALOGERO, J., would grant the writ.
