State v. Skipper

State v. Skipper
Supreme Court of Louisiana · Decided March 23, 1976 · Dixon, Summers
328 So. 2d 375; 1976 La. LEXIS 4707 (Southern Reporter, Second Series)

State v. Skipper

Opinion of the Court

In re: Billy Skipper and Ora Fondren, applying for supervisory writs or writ of certiorari and judicial review and for Stay Order.

Writ denied: No error in the rulings complained of.

Dissenting Opinion

SUMMERS and DIXON, JJ.,

are of the opinion the statute upon which this conviction is based is an unlawful delegation of legislative power to an administrative agency based principally upon the vague and indefinite standard, “the interest of wildlife management”. See La.R.S. 56:121; State v. Billot, 154 La. 402, 97 So. 589 (1923).
