SUMMERS, J.,

is of the opinion this writ should be granted to reconcile the divergent holding in the courts of appeal on factual situations which are almost identical and without any relevant distinctions. It is a principal function of this court to carry out this obligation.

In re: The Fidelity and Casualty Co. of New York applying for certiorari, or writ of review, to the Court of Appeal, Third Circuit, Parish of Evangeline.

Writ refused. On the facts found by the court of appeal, 324 So.2d 895, there is no error of law in its judgment.
