State ex rel. Clark v. Marullo
Supreme Court of Louisiana · Decided March 19, 1976 · Dixon
328 So. 2d 377; 1976 La. LEXIS 4785 (Southern Reporter, Second Series)
State ex rel. Clark v. Marullo

Concurring Opinion

DIXON, J.,

concurs in the denial; applicant must file another petition in this court to obtain a review of the trial court’s action. State ex rel. Matthews v. Henderson, La., 292 So.2d 496, cannot be used to justify transporting prisoners from parish prisons to Angola pending appeal, absent most exceptional circumstances.

Opinion of the Court

In re: Albert Clark applying for Writ of Mandamus and Habeas Corpus.

Writ denied. Since the trial judge has acted upon applicant’s petition for habeas in the trial court, this application to force him to do so by mandamus is moot.
