Supreme Court of Louisiana · Decided May 28, 1976
332 So. 2d 483; 1976 La. LEXIS 4652 (Southern Reporter, Second Series)

Luneau v. Walker-Roemer Dairies, Inc.

Opinion of the Court

In re: Doyle Luneau, applying for supervisory writs.

Writ denied. We can find no abuse of discretion in the grant of á new trial, Louisiana Code of Civil Procedure, Arts. 1972, 1973; nor can we say that La.Code of Civil Procedure, Art. 1978 does not validly apply to a jury trial, at least if the trial court does not deny the plaintiffs the right to recall the witness for the reexamination or cross-examination if the new trial is con ducted before a jury.
