Writ denied. On the facts found by the court of appeal, there is no error of law in the judgment complained of.

Dissenting Opinion

TATE, J.,

respectfully dissents. Although the majority characterizes the issue as factual, the findings of the trial court show disabling aggravation of a pre-exist-ing condition, which evidence, in my opinion, was incorrectly construed as not proving an “accident”.
