SUMMERS, J.,

concurs agreeing that the order was improvidently granted because there has been no showing, and he is not prepared to assume, that the news media will not use reasonable restraint, under the circumstances of this and its companion case, in reporting the trial events.

Opinion of the Court

In re: The Times-Picayune Publishing Corp. applying for Writs of Certiorari, Review, Prohibition, Mandamus and Stay Order.

Writ granted. The trial judge’s order of 7/7/76 restraining the news media is vacated and set aside. Prior restraint in this case is not warranted. See Nebraska Press Association v. Stuart, - U.S. -, 96 S.Ct. 2791, 48 L.Ed.2d -, dec. June 30, 1976.
