TATE, J.,

dissents. The issue of the abuse of the trustee’s discretion presents a serious issue in the development of trust law which affects the widespread portion of employment profit-sharing plans. This court should grant certiorari and review this issue.

Opinion of the Court

In re Alto Employees’ Trust and A. A. Harmon, Sr., etc. applying for certiorari, or writ of review, to the Court of Appeal, 332 So.2d 582, Fourth Circuit, Parish of Orleans.

Application denied; there is no error of law in the judgment of the court of appeal.

SUMMERS, J., is of the opinion the writ should be granted.
