Louisiana Horticulture Commission v. Kuharcik

Supreme Court of Louisiana
Louisiana Horticulture Commission v. Kuharcik, 338 So. 2d 702 (La. 1976)
1976 La. LEXIS 4084
Dennis

Louisiana Horticulture Commission v. Kuharcik

Opinion of the Court

In re: Joe Kuharcik, applying for certio-rari, or writ of review, to the Court of Appeal, 335 So.2d 56, Fourth Circuit, Parish of Orleans.

Writ refused. Based on the assignments of error, there is no error of law in its judgment.

Dissenting Opinion

DENNIS, J.,

is of the opinion the writ should be granted because R.S. 37:1964, subd. C requires but one $25.00 annual fee for each separate establishment or place of business. R.S. 37:1963(21) defines “place of business” as a “permanent establishment”. The facts found by the Court of Appeal opinion show that applicant has but one “permanent establishment”.
