Opinion of the Court

In re: Donald Robinson, applying for writs of certiorari, prohibition and mandamus.

Writ granted. The State is ordered to grant defendant a trial on or before January 17, 1977, or release the defendant. In the event of impossibility to comply with this order its right to apply to this Court for relief is reserved.

Dissenting Opinion

SANDERS, C. J., and SUMMERS and MARCUS, JJ.,

would not order the release of this applicant as the majority orders. No adequate showing has been made of prejudice and the prescriptive period for this prosecution has not run.
