Granted. An evidentiary hearing is ordered on the issue of the impermissibly suggestive influence upon eye-witnesses’ identification of relator.

SUMMERS, J.,

dissents from this grant. I do not agree that the issue of an undue suggestive identification can be raised at this time, applicant having waived his right to appeal.
