State v. House

Opinion of the Court

In re: District Attorney, E. Baton Rouge Parish, applying for supervisory writs.

Writ denied. We find no abuse of the trial court’s discretion.

SANDERS, C. J., and SUMMERS and MARCUS, JJ., are of the opinion that a writ should be granted and the State allowed to offer evidence of the age of defendant. SUMMERS, J., is of the opinion the trial judge has abused his discretion in this case.
