Dissenting Opinion

DENNIS, J.,

dissenting. In the absence of a record clearly showing that the defendant waived his right to be present at rendition of verdict or waived the right to assistance of counsel at sentencing, I would grant the writ for the limited purpose of rendition of verdict and, in the event of conviction, the sentencing, in the presence of both the defendant and his attorney.
