In re: William Hawk Daniels, applying for writ of certiorari, prohibition and mandamus and stay order.

Writ denied. Relator is not entitled to the relief sought.

Concurring Opinion

DENNIS, J.,

concurs in the denial of the writ, but is of the opinion that had relator sought to subpoena witnesses for the preliminary investigation, instead of pre-inves-tigation hearing discovery, he would have been entitled to relief.

Dissenting Opinion

SUMMERS, J.,

is of the opinion Applicant is entitled to the issuance of subpoenae for the attendance of witnesses and for the production of documents.
