SUMMERS, J.,

dissents from the granting of the delay. This action of the Court delays the progress of this prosecution and the resolution of res nova issues affecting numerous prosecutions throughout the state.

*378DIXON, J., dissents from granting this motion. CALOGERO, J., dissents, believing the motion should not be granted.

Opinion of the Court

In re: Motion to Recall Writ of Certiorari, to Remand the Case, and to Dismiss Proceedings, 342 So.2d 1117.

Motion granted and stay order recalled. The case is remanded to the Third Judicial District Court for the sole purpose of permitting the District Attorney to dismiss the case.
