Pugh v. Theall

Pugh v. Theall
Supreme Court of Louisiana · Decided April 27, 1977 · Summers
344 So. 2d 1055; 1977 La. LEXIS 5305 (Southern Reporter, Second Series)

Pugh v. Theall

Concurring Opinion

SUMMERS, J.,

I concur in the denial of this application on the ground that the result is correct. However, I am of the opinion that the maiden name of the wife should be used in all transactions affecting real estate. Reliance upon custom has the effect of rendering uncertainty to transactions requiring more definite rules.

Opinion of the Court

In re: Walter Theall and Joseph Maxie Pierce applying for certiorari, or writ of review, to the Court of Appeal, 342 So.2d 274, Third Circuit, Parish of Vermilion.

Application denied; the judgment of the court of appeal is correct.
