State v. O'Brien

Opinion of the Court

In re: Robert O’Brien, et al. applying for writs of certiorari.

Writ granted in part. It is ordered that the probable-cause hearing be reopened to allow the defense to recall and cross-examine Deputy Sheriff Abadie. In all other respects the application is denied.

Dissenting Opinion

SUMMERS, J.,

dissents from the granting of this writ. The finding that these defendants and five others were in possession of $10,000,000. worth of marijuana overwhelmingly established probable cause to charge them.
